Terms of Service

1. Agreement These Terms of Service (“Terms”) form a binding agreement between you and Bamona, LLC, a Delaware limited
   liability company (“Bamona,” “we,” “us,” or “our”), governing your access to and use of our websites,
   products, and services, including ModeratorX (the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the
   Services. If you use the Services on behalf of an organization, you represent that you have the authority to
   bind that organization to these Terms.
3. Description of Services Bamona provides software, AI-powered tools, digital platforms, and automation solutions for businesses and
   individuals. Specific Service features, availability, and limitations are described on our website and within
   each product. We may modify, suspend, or discontinue any part of the Services at any time, with or without notice.
4. Accounts You may need to register an account to access certain Services. You agree to:

• Provide accurate and current information
• Keep your credentials confidential
• Notify us promptly of unauthorized access
• Be responsible for all activity under your account We reserve the right to suspend or terminate accounts that violate these Terms.

1. Acceptable Use You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law
• Reverse-engineer, decompile, or attempt to extract source code, except where permitted by law
• Use the Services to send spam, harass, or harm others
• Interfere with or disrupt the Services or their infrastructure
• Misuse moderation tools to facilitate harm or evade legitimate platform policies
• Upload viruses, malware, or other malicious code

1. Intellectual Property The Services, including all software, content, branding, and trademarks, are owned by Bamona, LLC or its
   licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive,
   non-transferable license to access and use the Services for their intended purpose. You retain ownership of
   content you submit to the Services, and you grant Bamona a license to process that content solely to provide
   the Services to you.
2. Third-Party Services The Services may integrate with third-party platforms (including Meta Platforms, Stripe, Supabase, and
   others). Your use of those services is governed by their own terms, and Bamona is not responsible for
   third-party actions, content, or policies.
3. Fees and Payment If you purchase a paid Service, you agree to pay the listed fees in the currency and on the schedule shown at
   checkout. Fees are non-refundable except as required by law or expressly stated. We may change pricing with
   reasonable notice for future billing periods.
4. Disclaimers The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. We
   do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements.
   AI-generated outputs are provided for assistance only and should not be relied upon as the sole basis for
   decisions with legal, financial, medical, or safety consequences.
5. Limitation of Liability To the maximum extent permitted by law, Bamona, LLC will not be liable for any indirect, incidental, special,
   consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to
   your use of the Services. Bamona’s total cumulative liability for any claim under these Terms will not exceed
   the greater of (a) the amount you paid to Bamona in the twelve (12) months preceding the claim, or (b) USD
   $100.
6. Indemnification You agree to defend, indemnify, and hold harmless Bamona, LLC, its members, managers, employees, and agents
   from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Services
   or breach of these Terms.
7. Termination You may stop using the Services at any time. We may suspend or terminate your access if you violate these
   Terms or for any other reason at our reasonable discretion. Sections that by their nature should survive
   (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive
   termination.
8. Governing Law and Dispute Resolution These Terms are governed by the laws of the State of Delaware, United States, without regard to its
   conflict-of-laws principles. Any dispute arising under these Terms will be resolved exclusively in the state
   or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing
   in this section prevents either party from seeking injunctive or equitable relief in any court of competent
   jurisdiction.
9. Changes to These Terms We may update these Terms from time to time. Material changes will be communicated by updating the Effective
   Date and, where appropriate, by additional notice. Continued use of the Services after changes take effect
   constitutes acceptance.
